Lawsuit filed against Obama challenging his citizenship

Pennsylvania’s former deputy attorney general and Sen. Hillary Rodham Clinton supporter Philip J. Berg has filed a lawsuit in federal court in Pennsylvania accusing presumptive Democratic presidential candidate Sen. Barack Obama of lying about his U.S. citizenship, which would make him ineligible to be president.

PHILADELPHIA - A Lafayette Hill attorney filed a lawsuit in federal court Thursday challenging Sen. Barack Obama’s claim to United States citizenship. The action seeks to remove the Democratic candidate from the November ballot.

  1. Interesting - let’s see what the obama camp has a defense. So far media is totally mum about this legal action.

  2. yeah this has been brewing for some time now. Of course the media usually runs 6-8 weeks behind blogs and internet rumors. But it appears there is teeth to the story. Let’s see what the reaction is over the next couple of weeks.

  3. I had dismissed all stories and accusations about this, until I found out about the lawsuit. It seems the Democrats are scared the GOP will use this to derail the election, as they should. The DNC should have done their own investigation a long, long time ago.

  4. This topic has been looked at and dismissed again and again, thats why the MSN, McCain’s campaign, and most blogs are ignoring it. The lawsuit is baseless slander and will fail.

  5. This is just politicians trying to find a way to put Obama in a negative light, and I expect it will work for some people.

    There is a confusion between jus sanguinis and jus soli. Jus Sanguinis is citizenship by blood and requires that at least one parent be a citizen for five years after the age of 16. Since Obama’s father was Kenyan and his mother was only 18, he fails citizenship under Jus Sanguinis.

    However, under Jus Soli (citizenship through place of birth) he is clearly a U.S. citizenship. He was born in Hawaii two years after it became a state, and according to the Constitution, “[a]ll persons born or naturalized in the United States , and subject to the jurisdiction thereof, are citizens of the United States and of the state wherein they reside.” Sorry guys but this will be an open and shut case.

  6. Obama’s mother went to Kenya with his father but wanted to come home for the birth of Obama. She was not allowed on the plane because she was to far along in the pregnancy. She had Obama in Kenya. The constitution states that in order for a child to be a U.S. citizen the child either has to be born in the U.S. or one parent has to be a U.S. citizen of the age of 19. Obama’s mother was 18 years old when she had Obama..

  7. kdog, the issue isn’t whether he’s a citizen. it’s whether he’s a natural born citizen. if he was born in kenya or canada or wherever, he isn’t. the issue of whether he was born in hawaii or somewhere outside the u.s. is a question of fact, to be determined by a jury.

    (of course, it’s possible he’s not a citizen at all).

    the lawsuit will work its way through the courts and whatever will be will be. the issue, however, is not political; it is a matter of law and fact. if he is not constitutionally eligible, he cannot be president - period.

    i suspect that either he was born in hawaii or, if not, he has managed to cover up/doctor any records to the contrary, so i suspect the suit will go nowhere, but we shall see.

  8. Natural born is not quite as black and white as you make it out to be. McCain wasnt born in the U.S.

    We are in agreement about the fact that the suit will go nowhere.

  9. Note to SPECIAL K: There is a provision that if a person is born to American citizens outside of the US they are citizens of the US. One of the reasons for this was so newborn’s of Military or Civil Service employees working outside the country on behalf of the US would be citizens. McCain was born in the Panama Zone when his father and mother were stationed there with the U. S. Navy.

    If in fact Hussein Obama was born in Kenya then he would be Kenyan by birth because although his mother was an American citizen by birth his father was not. As a note for your information many countries assign citizenship by that of the father regardless of birthplace. If a Dutch mother delivers a baby by a German father in Holland, the child is considered to be German by both governments.

  10. Yes you are correct Circle8 when I read the law there is also a provision in there that states, one of the parents must reside in the United States within 5 years prior to the birth.

  11. I have searched for an update on the lawsuit filed in August and no one has updated anything in more than two weeks. What are they waiting for? At first, I read that the judge wanted to make sure that depositions were processed. When will Obama be deposed? The fact that Obama was not vetted properly will now create an international embarrassment. I guess that he will just need to be deported.

  13. Pam, Obama has been served with the lawsuit. He was presented the paper during the DNC. That’s the latest.

  14. Legal action,

    Who will be president? If Obama were to be elected and legally disqualified afterward, would Biden become president? or Pelosi? or McCain by democratic default? None of these would be elected by the people and would not have their support. It would create an unstable environment.

    Painful as this may be, it is better to have Obama’s legal citizenship and qualification officially settled now.
